1. Scope

The following Terms and Conditions apply to all orders placed via our online shop. Our online shop is directed at consumers, associations, organizations, and museums.
A consumer is any natural person who enters into a legal transaction for purposes that are predominantly outside their commercial or independent professional activity.

2. Contracting Party, Conclusion of Contract, Correction Options

The purchase contract is concluded with eurofossils Dr. Martin Görlich.

By listing products in the online shop, we make a binding offer to conclude a contract for these items. You may first place products in the shopping cart without obligation and may correct your entries at any time before submitting your binding order. The contract is concluded when you accept the offer by clicking the order button for the items contained in the shopping cart.

The exact time at which the contract is concluded depends on the chosen payment method:

Prepayment (Bank Transfer)

PayPal
During the ordering process, you will be redirected to PayPal. After confirming payment, we request PayPal to initiate the payment transaction and thereby accept your offer.

Cash on Collection
We accept your order by sending a confirmation email within two days.

Credit Card
Payment by credit card is processed via an external payment service provider. Your credit card will be charged immediately upon completion of the order. The payment transaction is carried out automatically after you confirm your payment details.

3. Contract Language and Storage of Contract Text

The language available for contract conclusion is German.

We store the contract text and send you the order details and our T&Cs in text form. For security reasons, the contract text is no longer accessible online.

4. Delivery and Shipping Conditions

In addition to the stated product prices, shipping costs apply. Details are provided in the product listings.

Shipping Costs
Shipping costs depend on weight and size. No additional packaging fees or surcharges apply. All items are shipped as insured parcels via Deutsche Post.

Shipping within Germany:

• Up to 5 kg (insured up to €500) – 7,69 Euro

• Up to 10 kg (insured up to €500) – 10,49 Euro

• Up to 20 kg (insured up to €500) – 18,99 Euro

• Up to 31,5kg (insured up to €500) – 23,99 Euro

Shipping within the EU:

• Up to 5 kg (insured up to €500) – 17,49 Euro

• Up to 10 kg (insured up to €500) – 22,49 Euro

• Up to 20 kg (insured up to €500) – 28,48 Euro

• Up to 31,5 kg (insured up to €500) – 45,49 Euro

Please note that delivery may be delayed by 5–7 working days.

Higher weights and insurance coverage are available by arrangement. Most items are in stock. Shipping is carried out no later than the second working day after ordering.

Delivery Options:
We deliver to the address provided during the ordering process. Collection on site is possible by arrangement. Delivery to parcel lockers is excluded.

Transfer of Risk:

• Consumers: Risk transfers upon delivery of the goods to the customer.

• Businesses: Risk transfers upon handover to the carrier.

Non-Availability:
In case of partial or full non-delivery, the customer will be informed immediately and any payments will be refunded.

Transport Damage / Loss:
All items are carefully packaged and insured.

Return Policy
You have a statutory right of return of 14 days from receipt of goods. Return shipping costs must be borne by the customer. We recommend contacting us before returning items.

5. Prices and Payment Terms

All prices are total prices including statutory VAT.

Payment Methods:

Prepayment
Bank details will be provided in a separate email. Shipment after payment receipt.

PayPal
Payment is processed via PayPal. Further details are provided during checkout.

Cash on Collection
Payment is made in cash upon pickup.

Credit Card
For credit card payments, the charge is made immediately after completion of the order. Processing is carried out via a certified payment service provider.

6. Retention of Title

The goods remain the property of eurofossils until full payment has been received.

7. Right of Withdrawal

Consumers have a statutory right of withdrawal. Details are provided in the separate withdrawal policy.

8. Warranty and Guarantees

Statutory liability for defects applies.

For used goods: if a defect occurs after one year from delivery, claims are excluded. Defects occurring within one year may be claimed within the statutory limitation period of two years.

This limitation does not apply in cases of:

• injury to life, body, or health

• intentional or grossly negligent breach of duty

• fraudulent intent

• breach of essential contractual obligations (cardinal obligations)

• guaranteed characteristics

• applicability of the Product Liability Act

9. Liability

We are fully liable for:

• injury to life, body, or health

• intentional or grossly negligent breaches

• guaranteed characteristics

• product liability
  

In case of slight negligence affecting essential contractual obligations, liability is limited to foreseeable damages typical for this type of contract. Otherwise, liability is excluded.

10. Applicable Law

German law applies excluding the UN Convention on Contracts for the International Sale of Goods (CISG). Mandatory consumer protection laws of the consumer’s country of residence remain unaffected.

11. Alternative Dispute Resolution

We are neither obliged nor willing to participate in dispute resolution proceedings before a consumer arbitration board.
